If you do not agree to these terms, please do not use our website or services.

2. Eligibility

To use our services, you must be at least 18 years old and legally capable of entering into a binding agreement. By using our services, you represent and warrant that:

  • You are at least 18 years of age.
  • You have the legal capacity to enter into these Terms.
  • You will provide accurate, complete, and current information when registering or submitting forms.
  • You will promptly update your information if it changes.

3. Description of Services

JD Tax Pro Software provides professional tax software access, education, training, mentorship, onboarding assistance, business development resources, marketing materials, compliance resources, and support for tax professionals.

JD Tax Pro Software does not prepare individual tax returns for the general public.

4. No IRS Affiliation

JD Tax Pro Software is not the Internal Revenue Service and is not endorsed by, controlled by, or affiliated with the IRS. PTIN and EFIN applications are reviewed and approved exclusively by the IRS. JD Tax Pro Software provides education and application assistance only.

5. No Guarantee of Approval or Results

JD Tax Pro Software does not guarantee any of the following:

  • PTIN approval
  • EFIN approval
  • Bank product approval
  • Software approval
  • Employment
  • Clients
  • Income or revenue
  • Refund amounts
  • Business growth or business success
  • Specific tax return volume
  • Any particular professional result

Results depend on the participant's qualifications, compliance, effort, business decisions, market conditions, and third-party approvals.

6. Educational Information Disclaimer

Training materials and website content are provided for educational and general business purposes only. They are not individualized legal, accounting, financial, investment, or tax advice. Participants remain responsible for verifying current laws, IRS rules, software procedures, and professional requirements applicable to their specific situation.

7. User Responsibilities

Users are responsible for:

  • Maintaining their own PTIN and EFIN when required by law
  • Following IRS due diligence requirements
  • Maintaining accurate client records
  • Protecting taxpayer information
  • Obtaining all legally required taxpayer consents
  • Maintaining their own Written Information Security Plan
  • Following applicable federal and state laws
  • Using software and bank products lawfully
  • Reviewing tax returns before submission
  • Supervising employees and preparers working under their business

JD Tax Pro Software is not responsible for a participant's errors, omissions, misconduct, tax return decisions, client disputes, penalties, rejected returns, or regulatory violations.

8. Account Security

You are responsible for maintaining the confidentiality of your account credentials. Accounts may not be shared, transferred, sold, or used by unauthorized individuals. You must immediately report any suspected unauthorized access to your account. JD Tax Pro Software may suspend access when fraud, misuse, security risks, chargebacks, or policy violations are suspected.

9. Payments and Billing

All prices are displayed before purchase. By submitting payment, you authorize the applicable charges. Payment plans must be completed according to the accepted schedule. Failure to complete payment may result in suspended access, collection activity, or termination from the program.

Participants remain responsible for applicable third-party fees, government fees, renewal fees, bank fees, transmission fees, and optional services unless the written offer specifically states that they are included.

10. Program Changes

Training schedules, instructors, software availability, bank product availability, resources, technology, and program delivery methods may change when reasonably necessary. Any change will seek to preserve the overall purpose of the purchased program.

11. Intellectual Property

All website content, videos, training materials, forms, templates, systems, graphics, branding, course materials, and original resources belong to JD Tax Pro Software or their respective licensors. Users may not copy, resell, reproduce, distribute, upload, record, share, teach, sublicense, or commercially exploit protected materials without written permission. Program access is granted only to the registered participant.

12. Recording and Sharing

Users may not record, livestream, screenshot for redistribution, republish, or publicly share private training sessions, software credentials, internal processes, participant information, or proprietary resources without written permission from JD Tax Pro Software.

13. Acceptable Use

The following activities are strictly prohibited:

  • Fraud or identity theft
  • Preparing or filing false tax returns
  • Unauthorized access to accounts or systems
  • Credential sharing
  • Harassment of staff, instructors, or other participants
  • Copyright infringement
  • Distributing malware or harmful code
  • Data scraping or automated access without permission
  • Impersonation or misrepresentation
  • Illegal marketing practices
  • Misuse of taxpayer information
  • Any action that damages the website, software, business, instructors, partners, or other participants

14. Third-Party Services

Our website and services may connect to third-party tax software, payment processors, CRM platforms, banks, enrollment providers, scheduling services, analytics providers, and external websites. JD Tax Pro Software does not control every third-party platform and is not responsible for third-party outages, policies, approvals, pricing, security practices, service interruptions, or decisions.

15. Taxpayer Information

Participants must not upload or disclose taxpayer information unless they have authorization and a lawful business reason. Participants remain responsible for complying with all privacy requirements, information security requirements, and applicable restrictions on using or disclosing tax return information.

16. Termination and Suspension

JD Tax Pro Software may suspend or terminate access for any of the following:

  • Nonpayment
  • Fraud or illegal activity
  • Threats or harassment
  • Credential sharing
  • Unauthorized copying of materials
  • Security violations
  • Misuse of taxpayer information
  • Chargeback abuse
  • Violation of program agreements or these Terms

Upon termination for cause, access to program materials may end. Any outstanding payment obligations remain due.

17. Disclaimer of Warranties

To the extent permitted by applicable law, services and website content are provided on an "as available" basis. JD Tax Pro Software does not promise uninterrupted, error-free, or completely secure access to its website or services.

18. Limitation of Liability

To the maximum extent permitted by applicable law, JD Tax Pro Software will not be liable for indirect, incidental, special, punitive, or consequential losses, lost profits, lost clients, lost data, lost business opportunities, tax penalties, rejected returns, third-party decisions, or service interruptions. Nothing in these Terms limits liability that cannot legally be excluded.

19. Indemnification

To the extent permitted by law, users agree to be responsible for claims and losses caused by their unlawful activity, misuse of services, violation of these Terms, infringement of another person's rights, improper handling of taxpayer information, or tax preparation activities conducted under their own business.

20. Force Majeure

JD Tax Pro Software is not responsible for reasonable delays caused by natural disasters, severe weather, government actions, internet outages, cybersecurity events, vendor outages, labor disruptions, health emergencies, or other circumstances beyond reasonable control.

21. Governing Law

These Terms are governed by applicable federal law and the laws of the State of Florida. Where legally permitted, disputes will be handled in Orange County, Florida. These Terms do not include mandatory arbitration or a class action waiver.

22. Changes to the Terms

Material updates to these Terms will be posted with a revised effective date. Where permitted by law, continued use of our services after notice of a material change may constitute acceptance of the updated Terms.

23. Severability and Entire Agreement

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force. Our failure to enforce any provision does not constitute a waiver of that provision. These Terms, together with our Privacy Policy, Refund Policy, and any applicable enrollment agreement, constitute the entire agreement between you and JD Tax Pro Software regarding your use of our services. These Terms may not be assigned by you without our written consent.
